Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "Customer", or "Mechanic") and Torrent Marine ("Torrent Marine", "we", "us"), governing your access to and use of the Torrent Marine web application, dashboards, integrations, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Torrent Marine is
Torrent Marine is a software-as-a-service tool for independent marine mechanics and marinas to manage jobs, customers, parts, photos, routes, and invoicing. Torrent Marine does not perform marine repair work, does not manufacture or sell marine parts, and is not a party to any transaction between you and your customers. You are solely responsible for the mechanical work, diagnoses, parts sourcing, safety, and any advice you provide.
2. Accounts and eligibility
You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at support@torrentmarine.com of any unauthorized use.
3. Subscription, billing, and free trial
The Service is offered on a recurring subscription, currently priced at USD $200 per month, following a 7-day free trial. A valid payment method is required to start the trial. Unless you cancel before the trial ends, your card will be charged automatically at the start of each billing period. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms. Fees are non-refundable except where required by law.
4. Your content and customer data
You retain ownership of the data you upload, including customer contacts, job notes, job photos, invoices, and part records ("Customer Data"). You grant Torrent Marine a limited, non-exclusive license to host, process, transmit, and display Customer Data solely to operate and improve the Service for you. You represent that you have the legal right to collect and upload this data (including consent from your customers to store their contact info and any photos of their vessels), and that your use of the Service complies with applicable law.
5. Third-party integrations
The Service integrates with third-party providers you choose to enable, including Stripe (payments and invoicing), Google Maps and Places (mapping, routing, marina lookup), Google Calendar (job sync), Open-Meteo (weather), and optional web-search / AI providers for parts lookup and labor-hour estimation. Your use of those providers is governed by their own terms. Torrent Marine is not responsible for the availability, accuracy, or content of third-party services. Prices, ETAs, labor hours, and weather data are estimates and must be verified before you rely on them.
6. Invoicing, markups, and taxes
Torrent Marine provides tools to calculate markups, shop supply fees, travel fees, labor rates, and sales tax, based on values you configure. You are solely responsible for confirming that your rates, tax collection, and invoicing comply with all applicable local, state, and federal laws. Torrent Marine does not provide tax, legal, or accounting advice.
7. Acceptable use
You agree not to: (a) reverse engineer, scrape, or resell the Service; (b) upload malware or content that infringes another party's rights; (c) use the Service to send unsolicited messages or invoices; (d) attempt to access accounts or data that are not yours; or (e) use the Service in a way that violates applicable law or these Terms.
8. Photos and condition evidence
Photos you take within the Service (including pre-job condition photos) are stored on our infrastructure and are visible only to your account. Photos are evidence you collect for your own records; they are not certified inspections and Torrent Marine makes no claim as to their evidentiary value in any legal proceeding.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be accurate or preserved.
10. Limitation of liability
To the maximum extent permitted by law, Torrent Marine's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. Torrent Marine is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility.
11. Indemnification
You agree to defend, indemnify, and hold Torrent Marine harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) your Customer Data, (b) the marine work you perform for your customers, (c) your invoicing, tax collection, or communications with customers, or (d) your violation of these Terms.
12. Suspension and termination
You may cancel your subscription at any time from Settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for non-payment, breach of these Terms, or activity that risks harm to the Service or its users. On termination, your right to use the Service ends immediately.
13. Changes to the Service or these Terms
We may modify the Service and these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their exclusive jurisdiction.
