Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you", "Customer", or "Mechanic") and Torrent Marine ("Torrent Marine", "we", "us"), governing your access to and use of the Torrent Marine web application, dashboards, integrations, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Torrent Marine is
Torrent Marine is a software-as-a-service tool for independent marine mechanics and marinas to manage jobs, customers, parts, photos, routes, and invoicing. Torrent Marine does not perform marine repair work, does not manufacture or sell marine parts, and is not a party to any transaction between you and your customers. You are solely responsible for the mechanical work, diagnoses, parts sourcing, safety, and any advice you provide.
2. Accounts and eligibility
You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at support@torrentmarine.com of any unauthorized use.
3. Subscription, billing, and free trial
The Service is offered on a recurring subscription, currently priced at USD $200 per month, following a 14-day free trial. No credit card or billing information is required to begin the trial, and the trial does not automatically convert into a paid subscription or charge you when it ends. As a courtesy, we may email a reminder roughly three days before expiration, but delivery is not guaranteed. At the end of the trial, access to paid features is restricted unless you affirmatively subscribe and provide a payment method through Stripe Checkout. By subscribing, you authorize recurring monthly charges until cancellation and also agree to Stripe's applicable terms. You can cancel, update your payment method, or download receipts from the Manage Subscription area, which opens the Stripe Customer Portal. Cancellation takes effect at the end of the then-current paid billing period. Fees are non-refundable except where required by law.
4. Your content and customer data
You retain ownership of the data you upload, including customer contacts, job notes, job photos, invoices, and part records ("Customer Data"). You grant Torrent Marine a limited, non-exclusive license to host, process, transmit, and display Customer Data solely to operate and improve the Service for you. You represent that you have the legal right to collect and upload this data (including consent from your customers to store their contact info and any photos of their vessels), and that your use of the Service complies with applicable law.
5. Third-party integrations
The Service integrates with third-party providers you choose to enable, including Stripe and Stripe Connect (payments, payouts, and invoicing), Google Maps and Places (mapping, routing, marina lookup), Google Calendar (job sync), Open-Meteo (weather), Brevo (email delivery), parcel carriers and third-party tracking pages (shipment status), and web-search / AI providers for parts lookup, repair assistance, and labor-hour estimation. Your use of those providers is governed by their own terms. Torrent Marine is not responsible for the availability, accuracy, or content of third-party services. Prices, ETAs, labor hours, and weather data are estimates and must be verified before you rely on them.
6. Invoicing, markups, and taxes
Torrent Marine provides tools to calculate markups, shop supply fees, travel fees, labor rates, and sales tax, based on values you configure. You are solely responsible for confirming that your rates, tax collection, and invoicing comply with all applicable local, state, and federal laws. Torrent Marine does not provide tax, legal, or accounting advice.
7. Acceptable use
You agree not to: (a) reverse engineer, scrape, or resell the Service; (b) upload malware or content that infringes another party's rights; (c) use the Service to send unsolicited messages or invoices; (d) attempt to access accounts or data that are not yours; or (e) use the Service in a way that violates applicable law or these Terms.
8. Photos and condition evidence
Photos you take within the Service (including pre-job condition photos) are stored on our infrastructure and are visible only to your account. Photos are evidence you collect for your own records; they are not certified inspections and Torrent Marine makes no claim as to their evidentiary value in any legal proceeding.
9. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be accurate or preserved.
10. Limitation of liability
To the maximum extent permitted by law, Torrent Marine's total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. Torrent Marine is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility.
11. Indemnification
You agree to defend, indemnify, and hold Torrent Marine harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) your Customer Data, (b) the marine work you perform for your customers, (c) your invoicing, tax collection, or communications with customers, or (d) your violation of these Terms.
12. Suspension and termination
You may cancel your subscription at any time from Settings; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for non-payment, breach of these Terms, or activity that risks harm to the Service or its users. On termination, your right to use the Service ends immediately.
13. Changes to the Service or these Terms
We may modify the Service and these Terms from time to time. Material changes will be announced by email or in-app notice at least 14 days before they take effect. Continued use after changes take effect means you accept the updated Terms.
14. Platform administration, telemetry, and support access
To keep the Service reliable, Torrent Marine operates an internal, admin-only oversight panel. Authorized Torrent Marine staff may view operational telemetry about your account, including session presence (online/offline and last activity time), login frequency, counts of AI diagnosis and labor-guide lookups, service-kit usage, the number of active shipment tracking numbers, Stripe Connect status, invoice totals and paid/unpaid counts, and application error events. This data is read-only operational metadata; staff do not use it to alter your jobs, customers, or invoices.
Administrators may also: extend your free trial, send you a direct in-app system message, waive or reinstate your subscription fee (a "comped" account), request a cache/session refresh of your app, and enable a temporary "developer support mode" that records front-end error and console output from your browser session for troubleshooting. Developer support mode captures technical diagnostics only and is used solely to resolve issues you report or that we detect. You may email support to request it be turned off.
15. Payments to you, Stripe Connect, and platform fees
If you enable customer payments, you must complete Stripe Connect onboarding and accept Stripe's Connected Account Agreement. Stripe — not Torrent Marine — holds funds, performs identity and compliance checks, and settles payouts to your bank account. Torrent Marine never takes custody of your customers' funds.
For each invoice paid through the Service, Torrent Marine collects a platform commission of one percent (1%) of the invoice total as a Stripe application fee, deducted automatically at the time of payment and separate from Stripe's own processing fees. If you enable the credit-card fee passthrough option, the card processing cost is added as a visible line item on your customer's invoice; you are responsible for confirming that surcharging is lawful in your jurisdiction and for disclosing it to your customer. Chargebacks, refunds, and disputes are handled between you, your customer, and Stripe; you remain liable for amounts reversed, including any platform fee already collected.
The Service also provides a public invoice payment page (for example torrentmarine.com/pay/…) that displays the itemized invoice, job photos you attach, and a payment button. Anyone with the link can view that page, so treat invoice links as semi-public and share them only with the intended customer. A "Mark as Paid" control lets you record payments taken outside the Service; accuracy of those records is your responsibility.
16. AI features and estimates
The Service includes AI-assisted features, including the AI Repair Assistant (symptom analysis and suggested diagnoses), AI labor-hour estimation when a factory guide does not cover a task, and AI-assisted parts matching. These outputs are generated by third-party AI models and are informational estimates only. They are not professional marine repair advice, not a substitute for factory service documentation, and may be incomplete or wrong. You must independently verify every diagnosis, labor hour, part number, and price before performing work or billing a customer. Torrent Marine disclaims all liability for reliance on AI output. Your customers' data is not used to train third-party AI models.
17. Parts ordering and shipment tracking
Parts search results, prices, availability, carrier detection, and delivery estimates come from third-party retailers, carriers, and tracking providers and may be inaccurate or out of date. Torrent Marine does not sell parts, is not a party to your purchases, and makes no guarantee of price, stock, ETA, or delivery. Tracking information may be displayed through embedded third-party tracking pages, which are governed by those providers' terms.
18. Offline mode and installable app
The Service may be installed as a Progressive Web App and stores a copy of your recent jobs, customer contacts, settings, and saved labor kits on your device so it keeps working without a connection. Changes you make offline are queued locally and sent to our servers when connectivity returns. You are responsible for securing any device on which you install the app, since cached business and customer data resides on that device. Torrent Marine is not liable for data lost before it syncs — for example if the device is wiped, the browser storage is cleared, or the app is uninstalled with unsynced changes pending. Uninstalling the app or clearing site data deletes the local copy.
19. Account security and password changes
Changing your password requires a multi-step verification: a six-digit code is emailed to your registered address and expires in ten minutes, after which you must supply your current password and confirm the new one. A successful password change signs out all other devices and is recorded in our internal audit ledger with a timestamp and your email address. You are responsible for maintaining access to your registered email address and for all actions taken by anyone who obtains your credentials or verification codes.
20. Complimentary and modified accounts
Torrent Marine may, at its sole discretion, extend a trial, waive or reinstate subscription fees, or designate an account as complimentary. Any such accommodation is revocable at any time, is not a contractual entitlement, and does not alter the remainder of these Terms.
21. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their exclusive jurisdiction.
